近日，浙江省市场监督管理局作出一则行政处罚决定，被处罚对象是杭州一专利代理机构，处罚理由主要是涉及非正常专利申请。
值得注意的是，该机构涉嫌代理疑似非正常的专利申请达1192件！

案件名称：杭州XXX专利代理事务所（特殊普通合伙）其他违反知识产权管理规定的行为案；
被处罚对象名称：杭州XXX专利代理事务所（特殊普通合伙）；
被处罚单位法定代表人姓名：李某；
主要违法事实：
2021年2月22日，国家知识产权局以《国家知识产权局办公室关于浙江省专利申请相关问题的通报》（国知办函保字[2021]161号）反映我省存在不以保护创新为目的的非正常专利申请情况，其中，涉及当事人代理的疑似非正常专利申请达777件。在收到整改要求后，当事人未认真整改，致使164件疑似非正常专利申请未撤回，且对其余当事人代理的专利申请未进行全面自查，致使2021年5月第二批非正常申请通报中，涉及当事人代理的疑似非正常专利申请达415件。综上，当事人涉嫌代理疑似非正常的专利申请达1192件。

2、北京市知识产权局
北京市知识产权局对5家从事非正常专利申请行为的代理机构做出行政处罚，处罚结果分别为：
代理1件非正常申请，警告；
代理9件非正常申请，警告+罚款9000元；
代理9件非正常申请，警告+罚款9000元；
代理22件非正常申请，警告+罚款22000元；
代理15件非正常申请，警告+罚款15000元；
